The Properties Wala is a digital real-estate and property discovery, listing and connection platform that helps users find, list, search, match and enquire about properties in Nagpur and other locations where services are available.

By accessing or using The Properties Wala website, installable app / PWA or any related service, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these Terms, please do not use the platform.

The Properties Wala facilitates property discovery, listings, searches, matching, enquiries and connections between owners, sellers, buyers, tenants, landlords, agents, businesses and corporate clients.

Unless separately agreed in writing, The Properties Wala is generally not the owner, seller, buyer, landlord, tenant, agent or broker of any property listed on the platform. We do not execute or conclude transactions on behalf of users unless a separate written agreement exists.

Users must provide accurate, truthful and complete information when registering or submitting listings. You must use the platform lawfully and in good faith, and must not impersonate another person or misuse another user's account.

You must have the legal capacity to enter into agreements under applicable law and must not be barred from using such platforms.

The platform may use mobile-number OTP authentication for registration, login, password reset and other sensitive actions. You are responsible for maintaining the confidentiality and security of your registered mobile number and any OTP received.

You are responsible for all activity that occurs through your account. Please notify us immediately if you suspect any unauthorized use of your account.

Listings on the platform may contain information such as property type, location, address, price, area, BHK, furnishing status, amenities, images, videos, description, availability, contact information and other details provided by the listing user.

The Properties Wala displays this information to help users discover and compare properties, but does not independently verify every detail unless specifically stated.

The person or entity submitting a listing is solely responsible for ensuring that they have the legal right, authority and consent to advertise the property, and that all information, images, pricing, availability, descriptions and other content are accurate, lawful and not misleading.

Listing users must also ensure that their listings comply with applicable laws, including advertising, RERA, copyright, data protection and consumer protection laws.

The Properties Wala does not guarantee, promise or represent that any property listed on the platform will be sold, purchased, rented, leased or otherwise transacted.

Specifically:

• Listings do not guarantee enquiries.
• Views do not guarantee enquiries.
• Leads do not guarantee conversion.
• Calls and WhatsApp enquiries do not guarantee conversion.
• Paid listings do not guarantee a transaction.
• The platform does not guarantee transaction price, timeline or terms.
• The final transaction decision, negotiation and agreement are solely between the relevant parties.

Users should independently verify ownership, title, documents, RERA details where applicable, statutory approvals, encumbrances, taxes, dues, area, condition, availability and the identity of the relevant party before entering into any transaction.

The Properties Wala does not claim that every property is legally verified unless the platform explicitly provides a written legal-verification guarantee for that specific listing.

Users are advised not to transfer money, pay advance amounts or make financial commitments solely based on online listings without proper verification of the property, parties and documents.

Do not share OTPs, banking credentials, passwords or other sensitive information with unknown parties. The Properties Wala may investigate, restrict, suspend or remove suspicious listings or accounts to protect users and the platform.

Users may submit property descriptions, images, videos, floor plans and other listing information only when they have the right, authorization or licence to do so. You must not submit fraudulent, misleading, illegal, defamatory, copyright-infringing, obscene, harmful or otherwise objectionable content.

The Properties Wala may review, edit, refuse, remove or disable content that violates these Terms or applicable law.

By submitting content to the platform, you grant The Properties Wala a limited, non-exclusive, royalty-free licence to display, format, reproduce, adapt, promote and distribute that content for the purpose of operating and marketing the platform, subject to applicable law.

This licence does not transfer ownership of your content to us and will be used only to the extent necessary for the platform's functioning and promotion.

The platform may provide free listings, paid listings, premium / featured listings and other services. Pricing, validity period, features and benefits are determined by the applicable pricing page and plan description.

Paid listings and promotional plans increase visibility but do not guarantee sale, rent, leads, enquiries or conversion. Any representations in marketing materials are indicative and not binding guarantees.

Listings may have statuses such as Active, Expired, Hidden, Suspended or Removed. An expired or hidden listing does not necessarily mean the property has been sold or rented; it may simply indicate that the listing plan has expired or the user has chosen to hide it.

Leads, calls and WhatsApp enquiries generated through the platform represent opportunities to connect and do not guarantee genuine buyers, tenants, sellers, successful transactions or any specific outcome.

Users are expected to communicate respectfully and lawfully through these channels.

The "Find Your Match" feature may use preferences such as city, locality, pincode, budget, category, property type, BHK, area and other filters to suggest properties.

A match or match score is an algorithmic suggestion only and does not guarantee suitability, availability, legal clearance, accuracy or transaction completion.

The Properties Wala may provide property sourcing, assistance and related services to companies, banks, retailers, businesses and other corporate clients for offices, shops, showrooms, warehouses, industrial spaces, bank branches, commercial properties and land.

Such sourcing or assistance does not guarantee that a suitable property or transaction will be found or completed unless separately agreed in writing.

Users must not:

• Upload fraudulent, misleading or fake listings.
• Misrepresent ownership or authority to advertise a property.
• Impersonate another person or entity.
• Manipulate views, leads, enquiries or platform metrics.
• Upload spam, repetitive content or unauthorised promotions.
• Scrape, copy or download platform data without authorisation.
• Attempt to bypass security, access controls or rate limits.
• Upload malware, viruses or harmful code.
• Harass, threaten or abuse other users.
• Use the platform for unlawful, fraudulent or harmful purposes.
• Misuse another person's information or contact details.

The Properties Wala may review, reject, suspend, hide or remove listings, accounts or content where reasonably necessary to protect users, maintain platform integrity, prevent fraud or comply with applicable law.

The Properties Wala name, logo, branding, website design, original content, graphics, software, features and other platform assets are protected by intellectual property laws. Users may not copy, reproduce, modify, distribute, sell or commercially exploit these assets without prior written permission.

The platform may use third-party services such as payment providers, OTP / SMS providers, WhatsApp, maps, hosting / cloud services and other technology providers where applicable. These services are governed by their own terms and policies.

We only reference providers that are actually implemented in our platform. The Properties Wala is not responsible for the availability, accuracy or practices of these third-party services beyond our reasonable control.

Continuous, uninterrupted availability of the platform cannot be guaranteed. The platform may experience downtime due to maintenance, technical problems, network issues, third-party outages or circumstances beyond our reasonable control.

To the extent permitted by applicable law, The Properties Wala shall not be liable for losses arising from incorrect user information, fraudulent users, ownership disputes, failed transactions, incorrect listings, actions or omissions of buyers, sellers, tenants, owners, agents, third-party services or circumstances beyond our reasonable control.

Nothing in these Terms attempts to exclude or limit liability that cannot legally be excluded or limited under applicable law.

To the extent permitted by law, users may be required to indemnify The Properties Wala against claims, losses, expenses, damages or liabilities arising from their violation of these Terms, fraudulent or unlawful activity, listing content, infringement of third-party rights or misuse of the platform.

Disputes relating to ownership, title, documents, price, payment, sale, rent, lease, possession, property condition, delivery or other transaction matters are primarily between the relevant parties, subject to applicable law and any separate written agreement with The Properties Wala.

The Properties Wala may suspend or terminate accounts or access for fraud, abuse, illegal activity, misleading listings, security risks, repeated violations of these Terms or other legitimate platform-protection reasons.

The Properties Wala may update these Terms from time to time. We encourage users to review this page periodically. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
